1. How does it work?
Your NSF check must be from California (and dated after January
1, 1996) or Nevada. For $12.99 per check CMA sends a certified letter identifying
the treble damage law and requesting certified funds or cash be sent to
you within 30 days. California Code 1719 and Nevada Revised Statute dictates
a thirty-day waiting period before treble damages can be assessed.
After the 30-day period, CMA adds treble damages to the amount
of the check and proceeds with collection action at our normal contingent
rates.
2. What are your rates?
-
20% on accounts UNDER one year from check date
-
25% on accounts OVER one year from check date
-
50% for accounts $500 and under.
The rate is calculated on the check amount plus the treble
damages.
3. Can you take checks from other states?
CMA can process checks from other states under our contingent
collection service. The treble damages will NOT apply for other states.
4. As the creditor what do I need to do?
Report all direct payments to CMA. Remember that after the
30-day period the account will move into collection action.
5. How do I pay for the service?
You can send us a company check with the placement form.
If you are a member, CMA can bill you for the service. CMA also accepts
VISA or MC for payment.
